H1-B FraudsLooks like the American senators are finally ready to fix the loopholes that consultancies use to deprive Americans of high-paying jobs. Senators Grassley and Durbin first introduced the legislation in 2007 and have been advocates for H1-B and L-1 visa reforms.

It is known that various consultancies, mostly run by Desi employers, make use of the loopholes in US laws and push forth Indian employees, thus making the Americans lose out on lucrative jobs they are capable of doing.

Similarly, there are others who enter the US on an L-1 visa and then get their employers to sponsor H1-B visas for them. The worst is fresh graduates from US colleges are hired as people with experience thanks to the loopholes.

With the new legislation, which is the H1-B and L-1 Visa Reform Act, fraud and abuse of the system will be reduced, and it will provide protections for American workers and visa holders. It will also make the system more transparent in the recruitment of foreign workers.

Most importantly, the legislation will ensure that companies with more than 50 H1-B or L-1 visas will be stopped from hiring additional employees.

While H1-B helps companies to hire for American jobs, L1 allows those hired on foreign soil to come work in America. In the new system, those with very good STEM skills and those with US advanced degree holders will be given preference. The legislation clearly prohibits replacing American employees with those from foreign lands.
