Courts have always stayed away from Telangana issue. Saying that Courts can not deal issues in consideration stage, Courts kept on striking down petitions asking them to come again at appropriate time. Now that the bill is passed in both the houses of Parliament, the petition will become eligible to be taken up by the courts.

BJP Senior leader Arun Jaitley repeatedly told in Rajya Sabha that there are constitutional violations in the bill regarding common capital and giving law and order powers to Governor. But the Congress government went on ignoring it. According to constitutional experts, vesting special powers in the governor to control law and order in the city which is not UT is a constitutional violation. Also a city with out being a Union Territory can not be a common capital of two states according to the constitution.

Former advocate general CV Mohan Reddy is of the opinion that the current bill with out constitutional amendments will be stricken off by courts if any one approaches them. Lets see if Judiciary applies brakes to Telangana which is till now cruizing off at jet speed.
