No chance of T-TDP merging in TRS?The MLAs of Telangana TDP who have defected to TRS are claiming that they are two-thirds of them coming out of TDP and can merge TDP Legislative Party in to TRS Legislative Party. This will ensure that the defected MLAs are treated as TRS members officially and there is no need to go to by-elections.

They are saying that this is in reference to the Tenth Schedule of Indian Constitution. However constitution experts say other wise. They say this provision was omitted from January 1st, 2004 with 91st amendment. With the omission, the provision of claiming a split in the legislature party can not permitted. Even if the Speaker approves it, the split can not stand in courts.

On the other side, there are misconceptions that TDP will be merged in to TRS. At best TDLP can be merged in to TRSLP through which by-elections can be avoided. TDP will continue to exist even with out a single MLA.
